Fees, Payments, and Cancellation Supplemental Terms

THESE FEES, PAYMENTS AND CANCELLATION SUPPLEMENTAL TERMS ("Fees and Payments Terms") form part of Sortit254's Terms of Service (the "Terms") and apply to each User's access to and use of the Sortit254 Platform, including the fees and payments associated with such access and use. Capitalised terms used but not defined in these Fees and Payments Terms will have the definitions as set out in the Terms.

A. Task Payment and Other Amounts Owed by the Client

All amounts owed and/or to be paid by you shall be set out in an Invoice ("Invoice(s)"), which will include the task-related fees and Sortit254 fees, each as described in more detail below in this Section A.

By providing a payment method, and upon receipt (whether through the Platform or via text or email) that the task has been completed, you authorise us to process your existing payment method. If we are unable to charge your existing payment method, you authorise us to use any other payment methods you have previously linked to your account.

To update your payment preferences, go to Your Account → Billing Info.

You acknowledge and agree that we may prevent you from booking future Tasks if any amounts remain outstanding on your account. Unless otherwise expressly stated in this Agreement, all fees (including, without limitation, the Task Payment and all Sortit254 fees) are non-refundable.

1. Task-related fees

The Client is responsible for paying the following for each Task:

  • The fee for the Task, at the Sorter’s rates and as agreed upon by the Client and the Sorter;
  • Any out-of-pocket expenses agreed upon by the Client and the Sorter and submitted by the Sorter in connection with the Task;
  • A tip or gratuity, as applicable, which may be given directly by the Client to the Sorter;

2. Sortit254 fees

In addition to the amounts owed for the Task as set out in Section A(1) above, Sortit254 charges, and the Client is responsible for paying, the following fees for each Task:

  • The Service Charge that Sortit254 assesses to the Client for access to and information regarding Sorters;
  • The Trust & Support Fee that Sortit254 assesses for customer support, service quality measures, and other related services.

Sortit254 reserves the right to change its fees at any time and will notify Clients of any fee changes. If you disagree with a Sortit254 fee change, you may stop using the Platform and terminate the Agreement.

Sorters have no authority to, and may not, modify any part of Sortit254’s fees.

B. Amounts Owed by Sorters

Sorters will be responsible for:

  1. Paying registration fees, if applicable; and
  2. Repaying to Sortit254 or the Payment Service Provider (“PSP”) any erroneous payments or other amounts received by the Sorter.

C. Payment Service Provider (“PSP”)

All amounts owed and/or to be paid by any User, other than tips, must be paid through the PSP.

The Client will be required to provide their payment method details to Sortit254 and the PSP.

The Sorter will be required to set up an account with the PSP, which requires registration with the PSP, consent to the terms of service of the PSP (the “PSP Services Agreement”), and completion of a vetting process and/or account validation.

Sortit254 is not a party to any PSP Services Agreement, and has no obligations, responsibility, or liability to any Sorter or other party under any PSP Services Agreement.

D. Fraud

Notwithstanding anything herein to the contrary, the Client will not be held responsible for transactions that are identified by Sortit254 as potential or confirmed fraud, provided that the Client did not contribute to or cause (directly or indirectly, in any part) such fraud. In such instances, a transaction may be declined, frozen, or held until investigation is complete.

E. Tax Collection and Remittance

Users of the Platform may be liable for taxes or similar charges (including VAT or any applicable Kenyan tax) which are imposed on the Tasks performed and/or fees paid under the Agreement and must be collected and/or paid.

In certain jurisdictions in Kenya, applicable rules may require that we collect and/or report tax and/or revenue information about you to the Kenya Revenue Authority (“KRA”) or other applicable tax authorities. You agree that Sortit254 may issue, on your behalf, receipts or similar documentation to facilitate accurate tax reporting, and use of your account may be paused until such documentation is provided.

Notwithstanding anything herein to the contrary:

  • Sorters remain fully responsible and liable for, and in charge of, compliance with all tax obligations applicable to them and the Tasks they perform, including filing their tax returns (such as VAT) and paying taxes (such as VAT) relating to the Tasks performed for Clients.
  • Sorters should consult their own tax advisors to ensure compliance with applicable tax and reporting requirements.
  • Sortit254 is neither responsible nor liable for ensuring Users' compliance with applicable tax obligations and shall not be held responsible for any breach of a Sorter's tax obligations.
  • Sortit254 may request a Sorter to confirm and/or demonstrate that they are up to date with their tax obligations, and may deactivate or limit a Sorter's account upon:
    1. Determination from tax authorities that the Sorter has failed to comply; or
    2. Failure or refusal by the Sorter to confirm compliance when requested.

F. Cancellation Fees

Clients may cancel a Task at any time. However, the Client may be billed a cancellation fee under certain circumstances, as outlined in Sortit254's Cancellation Policy.

Note: These Fees and Payments Terms apply only within Kenya and are subject to Kenyan laws and regulations.

Cancellation Policy

At Sortit254, we strive to provide a reliable, efficient, and fair platform connecting Clients with skilled Sorters. To ensure fair treatment of all Users and maintain high service quality, we have the following Cancellation Policy regarding Last-Minute Cancellations.

This policy applies to both Clients and Sorters. Users are strongly encouraged to:

  • Schedule tasks for times they are confident they can honour.
  • Avoid double-booking or conflicting commitments.
  • Keep their availability accurate.
  • Reschedule tasks as early as possible to avoid last-minute cancellations.

The requirements and examples below are not exhaustive and may be updated from time to time.

1. Client Cancellations

Clients may cancel a task at any time. However, a cancellation fee will apply if:

  • The task is canceled within 24 hours of the scheduled start time; or
  • The Client is unavailable or unresponsive ("No Show") at the scheduled start time, making it impossible for the task to be completed.

Conditions:

  • The Sorter must not have invoiced for the task.
  • The cancellation must not have taken place more than 30 days ago.
  • Same-day bookings that are canceled will be subject to the cancellation fee.

2. Exceptions – No Cancellation Fee Applies If:

  • The task was canceled within 5 minutes of booking.
  • The Sorter did not show up for the task.
  • The cancellation was due to incorrect address details provided by Sortit254 partners (where applicable).
  • The cancellation was due to a confirmed delivery delay for a partner-linked task.

3. Cancellation Fee Calculation

The cancellation fee will be charged to the Client's registered payment method and calculated as follows:

  • The equivalent of one (1) hour at the Sorter's hourly rate plus Sortit254 service fees; or
  • The minimum project price for that type of task; or
  • The applicable partner-set minimum rate (for partner-linked services).

4. Compensation to Sorters

For cancellations meeting the above criteria, affected Sorters will be eligible to receive:

  • The equivalent of 1 hour's pay at their set hourly rate,
  • The minimum project price, or
  • The Sortit254-set hourly rate (depending on the type of task).

Note: Sorters who have committed violations of the Sortit254 Terms of Service in the last 90 days may be ineligible to receive cancellation compensation.

5. Payment Timelines

  • Cancellation fee payments to Sorters may take up to 14 business days to reflect.
  • Clients can view applicable fees under their "Transaction History" on the Sortit254 platform.
  • If payment is not received after 8 business days, the affected Sorter should contact Sortit254 Support.

6. Refusal to Pay

If a Client refuses to pay the cancellation fee:

  • Their Sortit254 account may be suspended or deactivated.
  • They may be held liable for any additional costs incurred by Sortit254 or the Sorter as a direct result of the cancellation.

7. Policy Link to Terms of Service

This Cancellation Policy forms part of the Sortit254 Terms of Service. Violations of this policy may result in account limitations, suspension, or permanent deactivation.

8. Policy Updates

Sortit254 reserves the right to modify or update this policy at any time, with notice to Users via email or in-platform notification.

Category Descriptions Policy

At Sortit254, we strive to provide a reliable and efficient platform connecting Clients with skilled Sorters. To promote transparency and accurate task booking on the Sortit254 platform, we have established the following policy regarding category descriptions.

1. Applicability

This policy applies to all Sorters on the platform.

2. Policy Requirements

  • Clear Task Scope

Sorters must clearly describe the types of tasks they are willing and able to perform within each category. This should include a brief outline of their experience, expertise, and relevant skills for that category.

  • Tools and Equipment

Sorters are encouraged to specify in their descriptions any basic or specialized tools they can provide for the task. (Refer to the Sortit254 Tools Policy for more details.)

  • No Contact Details

Sorters must not include personal contact information in category descriptions. This includes, but is not limited to, phone numbers, email addresses, social media handles, or physical addresses.

  • No Incremental Fees in Descriptions

Additional charges or surcharges must not be listed in the category description. All pricing should comply with the Sortit254 Pricing Transparency Policy and Expenses Policy.

    Example of non-compliance:

  • No Minimum Hours or Hourly Rates in Certain Categories

For certain designated categories (e.g., partnerships or fixed-rate collaborations), Sorters must not mention minimum hours or hourly rates in the category description unless specifically permitted by Sortit254.

3. Enforcement

This policy is intended to clarify expectations under the Sortit254 Terms of Service. Violations may result in account limitations, suspension, or deactivation.

4. Right to Update

Sortit254 reserves the right to modify or update this policy at any time.

Communication After Task Invite Policy

At Sortit254, we are committed to providing a safe, respectful, and positive platform for all Users in Kenya. This policy sets out clear guidelines on how communication should take place between Sorters (those providing tasks) and Clients (those hiring Sorters) before, during, and after a task has been invited, accepted, or completed.

This policy applies to all Users of the Sortit254 Platform. Please note that the examples provided here are not exhaustive and are subject to change in line with our Terms of Service.

1. General Communication Rules

  • Prompt Responses: All task-related communication must be timely, clear, and respectful.
  • In-Platform Only: All communication must occur exclusively through the Sortit254 Platform (in-app chat or call features).
  • No Sharing of Personal Contacts:
    • Do not share or request personal contact details such as mobile numbers, WhatsApp handles, email addresses, or social media contacts before task completion.
    • Any arrangement to meet in person should be confirmed via the platform chat for record-keeping and safety.

2. Scope Changes and Documentation

Any changes to the agreed scope of work must be:

  1. Discussed in the Sortit254 chat thread; and
  2. Confirmed in writing by both Client and Sorter before proceeding.

Examples include:

  • Adding or removing items from the agreed work (e.g., more furniture to assemble, additional repairs, extra errands).
  • Changing task location or schedule.
  • Applying additional charges (subject to the Sortit254 Expense Policy).
  • Allowing a registered Sorter to delegate work to another registered Sorter.

3. Exceptions for Direct Contact

In the rare event that the in-app chat or call feature fails to work, Sortit254 may temporarily share limited contact information (phone number or email) to ensure the task proceeds on schedule.

  • Such contact must only be used for the specific task and must revert to in-app communication immediately after resolution.

4. Respectful Conduct

All messages, calls, and shared content must comply with Sortit254's Community Standards. This means:

  • No harassment, threats, or offensive language.
  • No sharing of inappropriate, misleading, or harmful content.
  • No discriminatory remarks based on tribe, religion, gender, or political affiliation.

5. Breach of Policy

Expense Policy

At Sortit254, we strive to provide a safe, transparent, and efficient platform connecting Clients with skilled Sorters across Kenya. To promote integrity, professionalism, quality, and accountability, we have set out the following policy concerning expenses on the platform.

This policy applies to both Sorters and Clients. Please note that the requirements and examples below are not exhaustive and may be updated from time to time.

1. Expense Eligibility

The Sortit254 platform allows Clients to reimburse Sorters for reasonable and necessary expenses incurred in the course of completing a task, subject to the following:

  • The maximum allowable reimbursement for a single task is KShs 2,000, except for waste disposal and furniture removal dump fees, which may be reimbursed up to KShs 10,000.
  • All eligible expenses must be directly related to completing the agreed task.
  • Items purchased as part of an expense must remain at the task site, except for disposal-related fees.

2. Approval Process

To ensure transparency and prevent disputes:

  • Agreement in Writing: Sorters and Clients must agree on any eligible expense in the Sortit254 chat thread before the purchase.
  • Proof of Purchase: Sorters must upload a clear, itemized receipt to the chat thread for every expense.
  • Bulk Purchases: If buying in bulk for multiple tasks, the Sorter must provide the original bulk receipt and a clearly itemized breakdown for the specific task.
  • Handwritten receipts are only acceptable when accompanied by the original bulk purchase receipt and must not be inflated to generate profit beyond what was agreed with the Client.

3. Non-Eligible Expenses

The following will not be reimbursed:

  • Parking, fuel, toll fees, or transport costs.
  • Payment for the Sorter's own tools, equipment maintenance, or personal use items.
  • Any items unrelated to the agreed task scope.

4. Pre-Payment Options

To make the process smoother, Clients may choose to pre-pay for anticipated costs. This may include:

  • Purchasing items online and arranging for the Sorter to collect them.
  • Calling the store in advance and paying directly over the phone.
  • Paying for supplies in advance with clear instructions to the Sorter.

Pre-payment helps avoid delays and ensures the task is completed successfully.

5. Exclusions

  • Expenses are not available for any tasks arranged through Sortit254 partner programs unless expressly stated. For guidance on additional labour or assistance costs, see the Sortit254 Invoicing Policy.

6. Policy Enforcement

  • All expense agreements and proof must be kept within the platform's chat to qualify for reimbursement.
  • Any attempt to submit fraudulent or inflated expenses will lead to account review and possible suspension or deactivation.
  • Sortit254 reserves the right to reject any expense that does not meet these requirements.
